Along with the completed Form W-7, you’ll submit identity documents and either a federal tax return or other documentation to show the federal tax purpose for which you need the ITIN. You can apply for an ITIN any time during the year when you have a filing or reporting requirement. If a person obtains an ITIN but does not include it on a federal tax return for three years in a row, it will expire and will need to reapply for one. So, to answer the second question, being a nonresident, or being a US resident alien for tax purposes, if you’re either one, it’s fine. It does not prevent you from getting an ITIN or being able to apply for one. It is important to note that a passport is the only documentation that can be used to prove both identity and foreign status.

Although both SSNs and ITINs are used for tax reporting, they’re issued by different agencies and have different benefits. A foreign entity that completes Form SS-4 in the manner described above should be entered into IRS records as not having a filing requirement for any U.S. tax returns.
